When ending a relationship, the issues that revolve around child care are some of the most important. In divorce and paternity proceedings, child custody and child visitation are intertwined. However, as of October 1, 2008, the state of Florida chose to stop using the familiar terms of “custody” and “visitation.” Instead, a “Parenting Plan” must be decided upon that details the “time-sharing” that will occur between each parent and each child.

The most common arrangement is that one parent is awarded majority time-sharing (physical custody) while the other is awarded time-sharing (visitation) rights. Of course, joint physical custody is also a possibility and may be referred to as “rotating custody,” “substantial shared parenting,” “50/50 custody,” or “50/50 time-sharing.”

In Florida, it is a matter of public policy to ensure that parents share responsibility for raising children. It is also public policy that minor children see parents frequently and on a continuing basis after the parents are separated or divorced. Child visitation, pursuant to a parenting plan, can take a variety of forms or schedules. Some common arrangements include some of the following provisions:

  • Alternate weekend visitation with the non-custodial parent;
  • Mid-week visitation with the non-custodial parent;
  • Sharing of the child during periods of school recess;
  • New Year's Eve, Easter, Rosh Hashanah and Yom Kippur, Thanksgiving, and Christmas with one parent or the other in alternate years;
  • Mother's Day with mother, Father's Day with father; and
  • Alternate years on the child's birthday.
